Veterans Benefits

According to United States Department of Veterans Affairs, approximately 20% of the U.S. population is made up of veterans, survivors of deceased veterans, and dependents of living veterans.

The US Department of Veterans Affairs (VA) offers a broad range of services and benefits for veterans. Unfortunately, many older veterans and their families do not utilize these services because they do not realize that the services exist or that they may qualify for the benefits. VA benefits attorneys specialize in this area.

While numerous military veterans are entitled to veteran’s disability benefits, every year the government rejects thousands of these claims. During your service in the military, you may have been exposed to war zones or other hazardous conditions that are only now affecting your health. Veteran’s disability benefits were designed to help you through these difficult experiences.

Types Of VA Benefits

Military veterans may be eligible for two types of veterans’ disability benefits:

  • service-connected compensation
  • non-service connected pension

Service-connected compensation may be available for veterans with an injury or illness that developed or was aggravated during active duty.

A non-service-connected pension may be available to members who served at least 90 days of active duty, including at least one day during a period of war. To be eligible for a non-service connected pension, you must meet the requirements and be permanently and totally disabled or older than 65. A surviving spouse, child, or parent may also be entitled to some benefits.

Certain diseases and disabling conditions that are diagnosed after military service are presumed to be service-related and entitle a veteran to VA disability benefits. For example, exposure to certain toxic chemicals such as agent orange during military service may cause the development of diseases later in life that is presumed to be connected to the veteran’s military service.

How To Apply For VA Disability Benefits

To apply for either service-connected or non-service-connected veterans’ disability benefits, you can file an application in person with the Veterans Administration regional office, by mail, or by visiting the website eBenefits. Veterans will receive a rating decision. Conditions that qualify for VA disability payments are rated on a scale of 10 percent to 100 percent disability.

Most of the time, the VA disability rating decisions are not favorable. You may be denied VA benefits, or you may not be granted full benefits. This is where a VA certified disability attorney in Tampa can assist. After receiving your rating decision, you have one year to appeal this decision by filing a Notice of Disagreement.
